Agreement to Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you and Nick Thompson trading as Fledge ("we", "us", "our") governing your access to and use of the Fledge mobile application ("App") and website at fledgeapp.online ("Website"), collectively referred to as our "Services".

Fledge is an independent service and is not affiliated with, endorsed by, or associated with any school, local authority, Ofsted, the Department for Education, or any other government body. All school data is sourced from publicly available government databases.

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Services.

We reserve the right to modify these Terms at any time. Your continued use of our Services following any changes constitutes acceptance of the revised Terms.

Description of Services

Fledge provides a mobile application and website designed to help parents, guardians, and families in the United Kingdom find, compare, and research secondary schools. Our Services include:

  • Location-based search for secondary schools within a specified radius
  • School profiles containing official data including Ofsted ratings, performance metrics, and admissions information
  • Filtering and sorting tools to refine school searches
  • School comparison features
  • Save and bookmark functionality for shortlisting schools
  • Map views and distance calculations
  • Calendar integration to add school open days to your device calendar (with your permission)
  • Optional push notifications for open day reminders

Eligibility

To use our Services, you must:

  • Be at least 18 years of age, or the age of legal majority in your jurisdiction
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Services under any applicable law

If you are using our Services on behalf of an organisation, you represent and warrant that you have authority to bind that organisation to these Terms.

User Accounts

Account Creation

Some features of our Services require you to create an account. You may create an account using:

  • Email and password
  • Sign in with Google
  • Sign in with Apple

When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your login credentials secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorised access or security breach

Guest Access

You may use certain features of the App without creating an account ("Guest Access"). Guest users can browse schools and view basic information. Creating an account is required to access Fledge Pro features such as saving schools and receiving notifications.

Account Termination

You may delete your account at any time through the App settings. We reserve the right to suspend or terminate your account if we believe you have violated these Terms or engaged in conduct harmful to us or other users.

Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Services for any illegal or unauthorised purpose
  • Attempt to gain unauthorised access to our systems, servers, or networks
  • Interfere with or disrupt the integrity or performance of the Services
  • Upload or transmit viruses, malware, or other harmful code
  • Scrape, harvest, or collect data from the Services using automated means without our prior written consent
  • Use the Services to harass, abuse, threaten, or harm others
  • Impersonate any person or entity or misrepresent your affiliation
  • Circumvent any technological measures designed to protect the Services
  • Use the Services in any manner that could damage our reputation or goodwill
  • Reproduce, duplicate, copy, sell, or exploit any portion of the Services without our express permission

School Data and Information

Data Sources

The school information provided through our Services is sourced from official UK government databases, including:

  • Department for Education - Get Information About Schools (GIAS)
  • Ofsted, ISI, Estyn, and Education Scotland inspection ratings
  • GCSE and A-Level performance data including Progress 8 and Attainment 8
  • Admissions statistics and catchment data
  • Attendance and exclusion rates
  • SEN/SEND provision data
  • School finances and per-pupil funding
  • Pupil demographics (FSM, EAL)
  • KS4 and KS5 destination measures

Data Accuracy & Disclaimer

All data in Fledge is sourced from official UK government databases. We show you everything that's available and tell you when it's not — not every school reports every dataset. Where data is missing, it is typically because the school has not reported it to the relevant government body.

While we work hard to keep information accurate and current, we cannot guarantee the completeness, accuracy, reliability, or timeliness of any school data displayed through our Services. School information can change without notice. There may be delays between official data being published and our Services reflecting those changes. Data may also contain errors introduced at source by the reporting bodies.

You acknowledge and agree that:

  • All school data is provided for informational purposes only and does not constitute advice
  • You must verify all important information directly with schools before making any decisions
  • Admissions criteria and processes vary by school and local authority, and may change from year to year
  • Performance and exam data reflects historical results and may not predict future outcomes
  • Data coverage varies — some schools have more complete records than others
  • Fledge is a research tool to assist your decision-making, not a substitute for your own due diligence

Admissions Information

Any admissions likelihood, catchment area, or "last distance offered" information provided through our Services is indicative only, based on historical data and distance calculations. This information should not be relied upon as a prediction or guarantee of admission. Catchment areas are approximations — real admission zones are irregular shapes that change every year depending on the applicant pool.

Actual admissions decisions are made solely by individual schools and local authorities based on their published admissions criteria. We accept no responsibility for any admissions outcomes.

No Responsibility for Decisions

Fledge is designed to help you research and compare schools. We do not provide educational advice, and we accept no responsibility for any decisions you make based on the information displayed in our Services. Choosing a school is an important decision that should involve visiting schools in person, speaking to staff and other parents, and consulting multiple independent sources of information.

By using our Services, you accept that you are solely responsible for any decisions you make in relation to school selection, admissions applications, or any other matter informed by data from Fledge.

User Content

You retain ownership of any content you create within the Services, such as personal notes and saved schools. By creating content, you grant us a limited, non-exclusive licence to store, process, and display that content as necessary to provide the Services.

You are solely responsible for any content you create and must ensure it does not violate any laws or third-party rights.

Intellectual Property

Our Intellectual Property

The Services, including the App design, Website design, features, functionality, graphics, user interface, and underlying technology (excluding government data), are owned by Fledge and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, lease, or create derivative works based on our intellectual property without our prior written consent.

Trademarks

The Fledge name, logo, and related marks are trademarks of Fledge. You may not use these marks without our prior written permission.

Feedback

If you provide us with feedback, suggestions, or ideas regarding the Services, you grant us the right to use such feedback for any purpose without compensation or attribution to you.

Subscriptions and Payment

Fledge offers a premium subscription ("Fledge Pro") that provides access to additional features.

Subscription Terms

  • Payment will be charged to your Apple ID account at confirmation of purchase
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase
  • Any unused portion of a free trial period will be forfeited when you purchase a subscription

Pricing

  • Prices will be clearly displayed before any purchase
  • Prices are in your local currency as determined by the App Store
  • We reserve the right to change subscription pricing with reasonable notice

Free Trial

New registered accounts may be eligible for a free trial period of Fledge Pro. During the trial:

  • You have full access to all Pro features
  • No payment is required during the trial period
  • Your trial begins when you create your account
  • After the trial ends, you can subscribe to continue using Pro features or continue with basic access

Trial availability and duration may vary and are subject to change at our discretion.

Refunds

All purchases are final. If you wish to request a refund, you must contact Apple directly through their App Store support, as Apple processes all payments. Refund eligibility is determined by Apple's refund policies.

Third-Party Links and Services

Our Services may contain links to third-party websites and services, including school websites, government resources, and mapping services. These links are provided for convenience only.

We do not control, endorse, or assume responsibility for any third-party content, websites, or services. Your use of third-party services is governed by their respective terms and privacy policies.

Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • The Services will meet your requirements or expectations
  • The Services will be uninterrupted, timely, secure, or error-free
  • The results obtained from using the Services will be accurate or reliable
  • School data will be complete, current, or free from errors
  • Admissions estimates or catchment information will reflect actual admission outcomes
  • Any errors in the Services will be corrected

WE EXPRESSLY DISCLAIM ANY AND ALL RESPONSIBILITY FOR DECISIONS MADE BASED ON INFORMATION PROVIDED THROUGH THE SERVICES. THIS INCLUDES, WITHOUT LIMITATION, SCHOOL SELECTION DECISIONS, ADMISSIONS APPLICATIONS, HOUSE MOVES MOTIVATED BY SCHOOL PROXIMITY, AND ANY OTHER ACTIONS TAKEN IN RELIANCE ON DATA DISPLAYED IN THE APP OR WEBSITE.

You use the information provided by Fledge entirely at your own risk. We strongly recommend that you independently verify all information with the relevant schools, local authorities, and official government sources before taking any action.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

IN NO EVENT SHALL FLEDGE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to access or use) the Services
  • Any conduct or content of any third party on the Services
  • Any content or data obtained from the Services, including school information, performance data, admissions estimates, and catchment information
  • Any decisions you make based on information provided through the Services, including school selection, admissions applications, or related matters
  • Inaccuracies, errors, or omissions in school data, whether originating from government sources or otherwise
  • Unauthorised access, use, or alteration of your transmissions or content

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

WITHOUT LIMITING THE FOREGOING, FLEDGE SHALL HAVE NO LIABILITY WHATSOEVER FOR ANY LOSS, DAMAGE, OR DISAPPOINTMENT ARISING FROM YOUR RELIANCE ON SCHOOL DATA, ADMISSIONS LIKELIHOOD ESTIMATES, DISTANCE CALCULATIONS, CATCHMENT AREA INFORMATION, OR ANY OTHER INFORMATION PROVIDED THROUGH THE SERVICES.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

Indemnification

You agree to defend, indemnify, and hold harmless Fledge and its directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt arising from:

  • Your use of and access to the Services
  • Your violation of any term of these Terms
  • Your violation of any third-party right, including intellectual property or privacy rights
  • Any claim that your content caused damage to a third party

Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

  • Your right to use the Services will immediately cease
  • You remain bound by provisions of these Terms that by their nature should survive termination
  • You may request deletion of your personal data in accordance with our Privacy Policy

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles.

Any dispute arising from or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer resident in the European Union, you may also bring proceedings in the courts of your country of residence.

Dispute Resolution

We encourage you to contact us first to resolve any disputes. Most concerns can be resolved quickly through our support channels.

For EU consumers, you may use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid while preserving its original intent.

Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by us to be effective.

Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Fledge regarding the Services and supersede all prior agreements and understandings.
